2014 Thunder Over Utah Promotion - Official Rules

  1. To Enter: Promotion entry deadline is April 19, 2014 at 11:59 PM EST; drawing to be held on April 21, 2014. Individuals wishing to participate in this Promotion must mail a plain piece of 3”x5” paper, with the individual's first and last name, date of birth, home address, home phone number and e-mail (“Registration Form”) to Thunder Over Utah Promotion, c/o Herb Gillen Agency, 1953 South Mallway Drive, Columbus, OH 43221. The Registration Form must be received by 11:59 PM EST April 19, 2014. Each purchaser of a general admission ticket to the 2014 Thunder Over Utah Air Show by 11:59 PM EST April 19, 2014 will automatically receive one entry and may mail a Registration Form as provided above to receive a second entry. Registration Forms with missing, incomplete or illegible information will not be accepted. Limited to one entry per person who does not purchase a general admission ticket and to two entries per person who purchases a general admission ticket. Ticket purchasers may opt out from participation in the Promotion by requesting so in writing to the address listed above. Important: No purchase is required in order to enter or participate in this promotion (see Rule #4 for details). No mechanically reproduced entries permitted. Sponsor is not responsible for lost, late, illegible, mutilated, misdirected, postage-due entries or entries not received in time for the random drawing. BY PARTICIPATING IN THIS PROMOTION, EACH INDIVIDUAL AND/OR ANYONE CLAIMING ANY PRIZE HEREUNDER IS AGREEING TO THESE OFFICIAL RULES AND THE SPONSOR'S DECISIONS, WHICH ARE FINAL.

  2. Eligibility: Promotion is open only to all legal residents of 48 contiguous United States and the District of Columbia who are 21 years of age or older as of the date of submission of the Registration Form or the date when the general admission ticket is purchased. Sponsor staff, and their employees, carriers, contractors, distributors, wholesalers and their immediate families (spouse, parents, children, siblings) are not eligible to enter. One winner per household. Void in Alaska and Hawaii, and where prohibited, taxed, licensed, or restricted by law. All federal, state and local laws and regulations apply.

  3. Prizes: One (1) Grand Prize – the once-in-a-lifetime opportunity for one (1) winner and up to five (5) additional guests to watch as the US Navy Blue Angels thunder by, land, taxi into position on the St. George Municipal ramp, and the crew finally climb out of the aircraft to greet their waiting ground crew as they arrive at St. George Municipal Airport on Wednesday, July 23rd, 2014 in preparation for their performances at the 2014 Thunder Over Utah Air Show.

    One (1) First Prize – the winner and one (1) guest will be able to watch up to one hour of the air show from the announcer stand. The timing of the viewing from the announcer's stand will be at the discretion of the air show.

    One (1) Secondary Prize - Officer's Club Ticket Upgrade. The winner and one (1) guest will have their tickets upgraded to Officers Club tickets for Sunday, July 27th.

    No substitutions, cash equivalents or transfer of prizes is permitted. Sponsor reserves the right to substitute any prize of equal or greater value in the event any prize cannot be awarded as stated. In no event will more than the stated number of prizes be awarded. Each winner agrees to be responsible for any and all local, state and/or federal taxes that may be assessed on the value of the winner's prize and for transportation to and from St. George Municipal Airport for himself / herself and all of his / her guests.

  4. Drawing: A random drawing will be held on April 21, 2014 from among all eligible entries and will be conducted by a representative of Thunder Over Utah. Odds of winning will depend on number of eligible entries received. The winner of the Grand Prize will not be eligible for other prizes. The winners of the First Prize will not be eligible for the Second Prize.

  5. To Claim Prize: All winners will be notified of the results by April 25, 2014 by e-mail only. All prize winners will be required to complete an Affidavit of Eligibility and a Liability Release in the form to be provided by Sponsor, which must be returned via e-mail, mail or fax within ten (10) days to Thunder Over Utah at the address listed in Section 1. Noncompliance within this time period or return of any prize notification as undeliverable will result in disqualification without further notice and an alternate winner will be selected as provided in Section 4. Failure by a winner of any prize to use the prize will result in forfeiture of the prize and an alternate winner may be selected as provided in Section 4. All tickets and other prize information will be sent to the winners at the contact information listed on their Registration Forms by July 7, 2014.

  6. Release: By acceptance of any prize, the winner agrees to indemnify, release and hold forever harmless the Sponsor, Thunder Over Utah Air Show, Herb Gillen Agency, their agents and representatives and each such company's officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death or damage to or loss of property, arising out of participation in the Promotion or in connection with receipt and/or use of any prize or any travel in connection therewith.

  7. Disputes: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the U.S. District Court for Utah or the appropriate Utah State Court located in Washington County, Utah under the laws of Utah without regard to that state's conflict of law's provisions.

  8. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit anyone's ability to participate in the Promotion; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion or receipt or use of any prize; (6) faulty, incorrect, undeliverable or mistranscribed phone or e-mail transmissions; (7) incorrect announcements of any kind. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Promotion. The Released Parties assume no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user's Internet service provider and/or e-mail client or for insufficient space in user's e-mail account to receive e-mail.

  9. Publicity: Except where prohibited, participation in the Promotion constitutes the winner's consent to the Sponsor's and its agents' use of the winners' name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media, worldwide, without further payment or consideration, unless prohibited by law.

  10. Generally: Thunder Over Utah will not collect or store information about Promotion participants except for the information set forth on the entry form. Information transmitted to Thunder Over Utah by electronic mail or otherwise will generally be treated as non-confidential and non-proprietary and may be used by Thunder Over Utah as set forth in paragraph 9 above.

  11. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Promotion and award the prizes from among eligible entries received prior to such action if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Promotion as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds or suspects to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

In the event a dispute arises regarding the identity of an entrant, entry will be deemed made by the person whose name appears on the Registration Form or information collected at the time of purchase of the general admission ticket to the air show. Proof of submitting entries will not be deemed to be proof of receipt by Sponsor. Any entries which are suspected of being fraudulent (including those using robotic, automatic, programmed or similar methods of participation) will be disqualified, based on Sponsor's determination.
